Welcome to Weekend Plans LLC dba Lake Norman Balloon Co. (“Company,” “we,” “us,” or “our”). By using our services, you (“Client,” “you,” or “your”) agree to the following Terms and Conditions. Please read carefully.
1. Scope of Services: We provide balloon décor, rentals, and installation services (“Services”). Details of specific projects, including pricing and delivery, will be outlined in a separate agreement or invoice.
2. Damages and Liability:
2.1 Damage During and After Installation: We exercise care during delivery and installation of your décor. However, once the installation is complete and delivery is confirmed, we are not liable for any damages to the décor or your property caused by environmental factors, misuse, tampering, or third parties.
2.2 Client Responsibility: It is your responsibility to ensure that all elements of the décor remain safe and intact after installation. Our Company will not be held liable for damages caused by balloons or rental items once we leave the premises.
2.3 Child and Pet Safety: Balloons can pose choking hazards all but especially to children and pets. It is your responsibility to ensure balloons are kept out of reach of children and animals. We assume no liability for any injuries or incidents resulting from improper handling of balloons or décor items.
3. Rental Policies:
3.1 Care of Rentals: All rental items must be treated with care. Rental items include but are not limited to stands, backdrops, frames, and other décor accessories.
3.2 Replacement Fees: If any rental items are lost, stolen, damaged, or destroyed while in your care, you will be charged the full replacement cost of the item plus a 20% procurement fee to cover restocking and administrative costs.
3.3 Storage of Rentals: All rentals must be stored indoors and handled with care until pickup. Rentals left outdoors or exposed to extreme weather conditions may be deemed damaged, resulting in a replacement fee.
4. Payments and Deposits:
4.1 Payment Terms: A deposit of 50% is required to confirm your booking, with the remaining balance due the day of the event. Failure to pay on time may result in a 20% late payment fee.
4.2 Non-Refundable Deposits: Deposits are non-refundable unless otherwise stated in your specific contract or invoice.
4.3 Late Fees and Additional Charges: Late payments will incur a fee of 10% for every 2 days past the due date.
5. Cancellations and Rescheduling:
5.1 Cancellations: Cancellations must be requested in writing at least 7 days before the event date. Any cancellations made after this period may incur additional charges
5.2 Rescheduling: Requests to reschedule are subject to availability and may incur an additional fee.
6. Environmental and Climate Factors: Balloons and décor are sensitive to environmental factors, including heat, humidity, wind, and rain. While we use high-quality materials, we cannot guarantee longevity or integrity of the décor if exposed to unfavorable conditions.
7. Image Usage: We may take photos of the décor and use them for promotional purposes, including social media, website, and marketing materials. If you wish to opt-out, you must notify us in writing prior to your event.
8. Permits and Permissions: It is your responsibility to obtain any necessary permits or permissions required for installation at your chosen location. We are not responsible for fines, penalties, or removal requests related to unauthorized installations.
9. Refund Policy: Refunds are not provided for any issues arising from circumstances outside our control, such as weather, client delays, or improper handling after installation.
10. Event-Specific Conditions: If the event requires us to return for removal of décor or rentals, a retrieval fee may apply. This will be outlined in your invoice.
11. Customization and Special Requests:
11.1 Custom Orders: Custom orders, such as specific balloon colors, branded designs, or specialty themes, must be requested and confirmed at least [insert timeframe] before the event. Additional costs may apply.
11.2 No Refunds on Custom Orders: Due to the custom nature of our products, no refunds or exchanges are permitted once the order is confirmed.
12. Indemnification: You agree to indemnify and hold harmless Weekend Plans LLC dba Lake Norman Balloon Co. and its employees, contractors, and affiliates from any claims, damages, losses, or liabilities arising from your use of our Services.
13. Force Majeure: We are not liable for delays or inability to perform Services due to causes beyond our control, including but not limited to natural disasters, acts of God, or other unforeseen circumstances.
14. Dispute Resolution: Any disputes arising under these Terms and Conditions will be resolved in accordance with the laws of the State of North Carolina.
15. Severability: If any part of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
16. Entire Agreement: These Terms and Conditions, along with the invoice or separate agreements, constitute the entire agreement between the client and the Company. No verbal agreements or changes are valid unless confirmed in writing.
17. Waiver: Failure by the Company to enforce any provision of these Terms and Conditions does not constitute a waiver of our rights.
18. Limitation of Liability:
18.1 Company Liability: The liability of Weekend Plans LLC dba Lake Norman Balloon Co. for any claims arising out of or related to the Services provided is strictly limited to the total fees paid by the client.
18.2 No Personal Liability: Under no circumstances shall Meghan Belmont or Julia McLaughlin, as co-owners of Weekend Plans LLC, be held personally liable for any claims, damages, losses, or disputes arising from Services provided by the Company. Any and all claims must be directed to the business entity, Weekend Plans LLC, and not to the individual owners.
19. Indemnification and Hold Harmless Agreement: You agree to indemnify and hold harmless Weekend Plans LLC dba Lake Norman Pumpkins, its owners (Meghan Belmont and Julia McLaughlin), employees, contractors, and affiliates from any claims, damages, losses, or liabilities arising from:
19.1 The use, handling, or installation of balloons, décor, and rentals.
19.2 The natural deterioration or discoloration of balloons or associated damages.
19.3 Any accidents or injuries resulting from the use of our products, rentals or Services.
19.4 This indemnification extends to all legal fees, costs, and expenses incurred in defending such claims.
20. Business Entity Protections: Weekend Plans LLC is a limited liability company (LLC), and as such, the liability of its owners (Meghan Belmont and Julia McLaughlin) is limited to the assets of the LLC. By engaging with our Services, you acknowledge and agree that the owners’ personal assets are protected under this structure and cannot be pursued for any business-related claims or disputes.
21. Acknowledgment of Protections: By booking with Weekend Plans LLC dba Lake Norman Balloon Co., you acknowledge and accept that:
21.1 The business entity is the sole party responsible for providing Services.
21.2 The individual owners, Meghan Belmont and Julie McLaughlin, are shielded from personal liability.
22. Acknowledgment: By booking with Weekend Plans LLC dba Lake Norman Balloon Co., you acknowledge and accept these Terms and Conditions in full.
